EPR in the US

Maine EPR Compliance Support

Maine

Maine’s EPR legislation, enacted in June 2021, focuses on various materials, including packaging, reusable packaging, and paper. The law mandates implementation by April 2026 and introduced a Stewardship Organization (SO) instead of a Producer Responsibility Organization (PRO). A request for proposals (RFP) for the SO will be issued in the spring of 2026.

Under this legislation, a “producer” is defined as the legal owner of a brand for products sold, offered for sale, or distributed in the state that utilize covered packaging materials. This definition also encompasses entities importing products with covered packaging into Maine when the brand lacks a physical presence in the US. Producers must register by the deadline, with initial payments due in 2026, to comply with the new regulatory framework.

What this means for you?

If your company sells into Maine, this may affect your reporting, internal data collection, packaging decisions, and long-term compliance planning.

Depending on your role in the supply chain, your organization may be considered the obligated producer. That responsibility can fall to the brand owner, trademark owner, licensee, importer, or distributor. For many companies, the real challenge is not just understanding the law — it is figuring out who is responsible internally, what information is needed, and how to prepare without overloading already stretched teams.

EPR is evolving across the U.S. What starts in one state can quickly become part of a much larger operational and financial burden.

Next steps

The best time to prepare is before compliance pressure builds. A practical first step is to confirm whether your company is obligated and identify what data, teams, and systems will be needed to respond.

From there, organizations should begin reviewing:

  • producer responsibility and legal entity exposure
  • packaging and material data availability
  • internal reporting processes and ownership
  • how Maine aligns with obligations in other U.S. states

Getting ahead now can reduce compliance risk, prevent last-minute reporting pressure, and help your team build a more manageable path forward
